Josh Hancock of the St. Louis Cardinals died last month when his SUV crashed into the back of a parked tow truck that was giving assistance to a stranded car.  Now we get word today that his father, Dean, is suing whoever he can over his son’s death.

Who is Dean Hancock suing?

1. Mike Shannon’s Restaurant (including Mike Shannon and his daughter Patrica who manages the restaurant)- for over-serving him
2. Eddie’s Towing- For not using flares or removing the vehicle in a timely fashion
3. Jacob Edward Hargrove- driver of the tow truck
4. Justin Tolar- the poor guy who was having car trouble

Now this what Josh Hancock was doing or had done at the time or the accident:

1. Blood-Alcohol level twice the legal limit
2. Talking on his cell phone to a female acquaintance
3. He wasn’t wearing a seatbelt
4. Police found marijuana in his vehicle
5. He was speeding

I understand his father is probably experiencing a lot of things right now from anger to pain to sorrow and probably even some self blame. However, suing everyone is not going to bring his son back.

“It’s understood that for the entire 3½ hours that Josh Hancock was there that he was handed drinks,” Keith Kantack, a lawyer for Dean Hancock, said. “It’s our understanding that from the moment Josh Hancock entered Mike Shannon’s that night that he was never without a drink.”

The lawsuit claimed Tolar was negligent in allowing his vehicle to reach the point where it stalled on the highway and for failing to move it out of the way of oncoming traffic. A police report said the car became stalled when it spun out after being cut off by another vehicle.

Police said Hargrove noticed the stalled vehicle and stopped to help. The report said he told officers he was there five to seven minutes before his truck was hit by Hancock’s SUV. But Kantack said the tow truck may have been there up to 15 minutes, yet failed to get the stalled vehicle out of the way.

I am a life long Cardinals fan but Josh was clearly at fault.  He was 29 year-old adult so there has to be some self responsibility.  I doubt he was falling down drunk and they kept serving him.  Dave Campbell of ESPN said he had an intelligent conversation with Hancock that night at the bar and that Hancock seemed pretty normal to him.

All the dirt comes out once you sue involving all parties. Dean Hancock should let his son rest in peace.
