Convicted Murderer Billy Flynn Asking For Early Release

Convicted murderer Billy Flynn has asked for an early parole from his sentence of forty years to life, he received seventeen years ago for shooting Gregory Smart in the back of the head. Flynn had been having an affair with Smart’s wife, Pamela Smart.

He is asking for an early parole. Under his original sentence he is not to be eligible for parole until after serving twenty-eight years of the sentence.

Flynn has apologized to the family of Gregory Smart and is hoping that his parole can be moved up due in part to his good behavior, accomplishments in prison (GED, etc.), and marriage while in prison.

“As soon as I walked in the room today, I felt a tremendous amount of shame, and I really want to apologize,” he said in a wavering, barely audible voice while clutching tissues in his hand.

She worked at Flynn’s high school and was having an affair with him.

Although he could have been charged with first-degree murder, as Pamela Smart was — a charge that carries a sentence of life without parole — under the terms of a plea deal, Flynn agreed to testify against her and pleaded guilty to second-degree murder. He was sentenced to 40 years to life, but is eligible for parole after 28.

Flynn was 15-years-old when he started sleeping with Pamela Smart. He was 16-years-old when he admitted to killing Gregory Smart. Pamela ordered him to kill her husband or else she would end the relationship.

Flynn told the Smart family he owed them an explanation, that at the time he was an isolated and lost teen and Pamela Smart filled every void in his life.

Flynn said she quickly began trying to leverage that against him, threatening to end their relationship if he didn’t murder her husband.

“It wasn’t just my relationship being threatened, it was my whole life and she knew that,” he said.

We like to poke fun of high school and middle school teachers who sleep with their students. The female teachers usually get slapped on the wrist in comparison to the sentences the men are handed. It is often hard to see the crime when a sexy teacher like Debra LaFave sleeps with one of her middle school students.

But there is a reason it is against the law and should be taken very seriously. Children are not mentally ready to be having sex at that age and especially not mentally capable of sleeping with their teacher or an adult. The case of Billy Flynn is a prime example of why it is important to protect children from sexual predators.


On a less serious note: Isn’t there an uncanny resemblance (see photos below) between Flynn and NBA basketball player Adam Morrison?

    Set him free, how else will he become a repeat offender and allow people like me to make a few bucks off it. On a more serious note, I have represented many teens that have done some horrible things, yes including murder. I firmly believe that some, not all, can be rehabed. However, they should only be released if they have a safe place to go and only after a long period of time that allows them to adjust to society as it is today compared to how it was when they got locked up. I don’t know enough about this guy to form a great opinion, but in most cases I have found that the victims family is okay with release when it is a teen offender. I wouldn’t be if it were my family, but my job forces me, as I am sure it does you as well with your past JH to look at things a little differently.

    KC: I agree he should probably be let free or freed to some sort of half-way house or supervised house or something. The kid was fifteen and the woman that took his cherry, probably had brain washed him, and told him to kill her husband. I can understand the anger of the victim’s family.

    I have been held at gunpoint in my apartment with a gun at my head. I have been woke up at 4am at Greece in 4 in the morning by the Greek Mafia looking for roommate. I have been jumped after a football game.

    I can understand how it would be hard to forgive someone who took your son or brother. That has to be an unbearable pain. That is why we have judges to make these tough calls.

    I do know KC aka Carl Lee Hailey what you would do if someone harmed one of your girls…and I can’t say I blame you. I’d probably be right there with you.

    I remember when you and the boys got held up at the apt. Its not funny but it kinda is. I would do a little more than ole Carl Lee if someone, touched my girls. I am not going to worry to much though, becasue as fine young republicans they will be able to shoot a zit off a bumble bee before they enter middle school.

    Billy Flynn has more than paid for whatever part he had in taking his teacher’s husband’s life. He was only 15 when that dreadful child molester first started to seduce him. Even before she seduced the poor kid into killing her husband, she was already a felon and guilty of a horrible crime of destroying a 15 year old boy’s life. If nothing else had happened after that he would have been affected just like all the young men that the Catholic church is now trying to assuage their suffering by offering millions of dollars to attempt to make up for their negligence in allowing their pervert priests to continue to sexually asbuse these boys. Pamela Smart was the plotter who deliberately seduced a 15 year old for her own purposes; to get him kill her husband. She is in prison for life and deserves it. That poor kid has suffered enough. It is time to let him go!!!!

    Billy Flynn should have known right from wrong at the age of 15, I know my sons do and I know when I was 15 I knew also. Yes Pamela Smart deserves to be in prison for life without parole, but Billy Flynn should serve out his sentence or at least the 28 years they gave him before being eligible for parole. Quite frankly, I’m tired of a sentence being handed down and then having the justice system parole people early. Billy Flynn didn’t bother to get to know the man he was being asked to execute. How do you think the family of the victim feels. The son they must live life without, the brother they will never see again or grow old with. Really place yourself in the shoes of the victims family before making snap judgements or saying what you would do if it was your family victimized.Think about someone executing your son, your brother and what you would really feel. I’m tired of hearing that he was a child at 15-he should have known better plain and simple, had he been raised with values and if not , well this is what happens to people who can’t function in society.

    Kris…if you think your kids know right from wrong, you’d better pay more attention to who they hang around with. I thought my kids did too and now, I visit one in prison and one is homeless due to drugs. the other 3 are doing perfectly well..so don’t get so arrogant about what kids will do. Billy Flynn has served a long time, but not nearly as long as Greg Smart will be dead. Too sad for all concerned. Especially the Smarts.

    I am usualy for a tough punishment on a criminal..especially if it is murder. It is rare that my heart goes out to a murderer but in the case of Bill Flynn it does. The Smart family has every right to feel the way they do and want this man to serve his term out..not a person in the world can fault them for that. Bill was a victim also..manipulated by a devious adult who played with a young troubled boy’s feelings and emotions to carry out a horrible crime. Bill Flynn did pull a trigger and deserved punishment for taking away a son/brother/friend to many people.Bill also still knew right from wrong regardless of his feelings..however I feel in this case 17 years in prison is punishment enough because of what this woman did to him.Pam Smart destroyed Bill and his family along with Greg Smart’s family. She is in for life and deserves her punishment.
