Jim Leyritz Arrested For Beating Karrie Leyritz (Photos)

Former Yankee player Jim Leyritz was arrested after beating up and dragging his ex-wife Karrie Leyritz out of bed because she had written a check without his permission early Thursday (June 2).

Karrie fled to the neighbor’s house for help and her ex-husband was only arrested later since he wasn’t at the home when cops arrived. Jim, who should be arraigned today, claims his ex-wife was drunk and hurt herself to frame him – something that was confirmed by one of their three kids – because he tried to evict her from the house they still share.

This incident occurred just a couple of month before Jim is to stand trial on charges of causing a fatal crash while driving drunk back in December 2007. The 45 year-old former catcher says he is still tormented by the death of Fredia Ann Veitch, victim of the crash.

The fact that Leyritz’ victim was drunk is immaterial. Leyritz was clearly at fault; his vehicle hit hers, and according to witnesses, he ran a red light.

There’s a big “but” here, however. According to the police report, the victim’s Mercury Montero, an SUV, was traveling west, while Leyritz’ Ford Expedition, also an SUV, was heading north. This means that Leyritz’ hit the passenger side of the vehicle.

The Montero rolled, and the victim was thrown from the vehicle because she, even drunker than Leyritz, wasn’t wearing a seat belt. Leyritz couldn’t have hit her that fast because the Expedition’s front airbag didn’t deploy. Had the Expedition been traveling faster than 15 mph, the airbag would have deployed.

Mitsubishi Monteros have a bad record for rolling over, plus, the victim was guilty of contributory negligence because she failed to buckle up. Would she have been killed if she were buckled up? Almost certainly not. Would she have been injured? Probably, but not seriously.

The proper charge against Leyritz is drunk driving causing injury. Don’t know the law in Fla. but in most states this would result in some jail time even for a first offender, which Leyritz is, on the order of 30 days, a license suspension of a year, a hefty fine, and a requirement that Leyritz make restitution.

Ironically, it would be easier to prove the criminal case than a civil case, because of the contributory negligence, and the historical poor performance in rollovers of the Mitsu.
