Mel Gibson lost control of his vehicle on Sunday night in Malibu, and it struck some rocky terrain.

First he crashes his career, and now his car? Poor guy can’t seem to catch a break.

Aside from his mental health, Mel appears to be all good; he told officers he was not on his phone and wasn’t snoozing.

Alcohol was apparently not a factor, and Gibson’s sweet ride, a Maserati, had to be towed from the scene.

From the report:

“For unknown reasons, Mr. Gibson steered his car to the right and struck the rock hillside. He stopped his car at the scene and was contacted by officers from the West Valley CHP Area.”

“Mr. Gibson supplied all the pertinent information to the officers at the scene, gave a statement, and received a ride home from a friend.”

California Highway Patrol spokesman Leland Tang told PEOPLE:

“There were no objective symptoms of intoxication, any level of impairment and we’ve ruled out speeding as well based on the damage to the car, which was moderate. Mr. Gibson was alert, oriented and cooperative.”

Cooperative? That sure doesn’t sound like the Mel we know.

Mel is still in the midst of a custody battle with his ex, Oksana Grigorieva, over their baby daughter Lucia Anne.

No offense to Mel, but I feel like the odds aren’t really in his favor.
