Halle Berry has pulled out of the Valentine’s Day sequel, New Year’s Day, due to a custody battle over her daughter that she is currently engaged in with her ex, Gabriel Aubry.

She was scheduled to film in New York this week but dropped out  ”due to pending custody litigation involving her daughter.” (via her publicist, Meredith O’Sullivan)

Halle is being replaced in the star-studded film by Katherine Heigl.

According to TMZ, the cast of Glee apologized to Lindsay Lohan for mocking her in an episode last year.

Lindsay was out at dinner in West Hollywood on Sunday night when she encountered the Glee cast out as well(without Jane Lynch and Lea Michele). The cast reportedly walked up to Lindsay’s table and apologized for the jokes in the episode, telling her they didn’t mean to hurt her feelings.

Halle Berry‘s rep has confirmed that the actress is preparing to go to court to fight for custody over her daughter Nahla, 2.

Her rep said:

“Halle has serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her.”

Apparently, Halle has been trying to solve the custody issue without going to court. Her rep added:

“She has attempted to resolve these custody issues amicably with her daughter’s father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention.”

“Halle has always made the needs and safety of her daughter her first priority and, both while Halle and Gabriel were a couple and since their break-up, Halle has only acted in her daughter’s best interest.”

Halle and Gabriel split back in April. He filed papers December 30, seeking to be formally recognized as Nahla’s father and to establish that he’ll share custody.

PBS has announced their plans to air the special 25th anniversary special of the musical Les Miserables, which starred Nick Jonas as Marius, Matt Lucas as Thenardier and Alfie Boe as Jean Valjean.

The production took place at the London O2 in October of 2010 and was broadcast in a number of US theatres as a one-night special.

Les Miserables has played in 42 countries and been seen by almost 60 million people since its opening in London in 1985.

The DVD of the performance will be available February 22, with the PBS special airing March 6.

Mötley Crüe since Vince Neil will serve 15 days for a drunk driving charge from last summer.

Vince will head to the Clark County Detention Center in Las Vegas on Feb. 15 to serve his sentence, which is part of a plea deal. In addition, he will serve 15 days on house arrest.

But even grown men can learn a new lesson. The 49-year-old rocker told PEOPLE:

“I made a mistake, and I have to finally learn my lesson and go do a little bit of time,”

“I’ve already learned my lesson.”

“I just have to move on and get past it and get it behind me.”

Unfortunately, Vince should have learned his lesson the first time he faced this situation. In 1984, Vince pleaded guilty to a DUI and vehicular manslaughter — his negligence left fellow musician Nicholas “Razzle” Dingley dead.

Second time is a charm? Fingers crossed…

Because of Chris Brown‘s good behavior, his ‘stay away’ order to keep him away from his ex, Rihanna, may be reduced.

Brown attended a hearing on Friday where the judge considered the option of reducing his order to a ‘do not annoy’ order. The original ‘stay away’ order indicated that Chris and Rihanna were not to talk and avoid eachother at events, though I’m sure that was no problem for the abusee.

Though, in order to implicate the ‘do not annoy’ order, Rihanna’s attorney has to approve — so the idea is still pending. Chris has been a good boy so far — he successfully completed a domestic violence course in December.

Speaking of a ‘do not annoy’ order, I have a few Top 40 stars I’d like to have ‘do not annoy’ orders against….

“I’m taking season 12 off.”

He’s taking the season off to play the  lead role in the upcoming dance movie Cobu 3D, which is scheduled to film in New York and Toronto this spring.

People Magazine reports:

“Hough will play a New Orleans street dancer who moves to New York and falls for an Asian drummer (played by Korean pop recording star BoA). The Romeo and Juliet-style love story (their dance groups are rivals) will be accented by “some incredible dance numbers,” says Hough. “People will see a much edgier side of me and these other styles of dance I’m capable of doing.” “

Sigh. Good news though, Derek told the magazine he’s gained almost 10 lbs. in muscle for the film. SWEET! He added:

“I will be making it back to Dancing with the Stars in the fall. I’m just taking a little break and taking this chance to grow and expand a little bit as an artist. It’s like I told one of the producers on the show – I’ll come back with a whole new set of skills.”

Tony Parker and Eva Longoria filed for divorce in November, but as of Friday the former power-couple are officially divorced.

Tony and Eva were married just three years — not even halfway to the ‘seven year itch’ — which kind of makes you wonder what they had in common with one another in the first place. Maybe Eva just wasn’t expecting to have to share her husband with other women? That would be considered ‘irreconcilable differences,’ which is what she filed in the first set of papers.

Because Tony is a San Antonio Spur and Longoria is a Texas native, they finalized their divorce in the Lone Star State. Yee-haw!

Katy became Mrs.Brand last October when she married comedian Russell Brand in an elaborate Indian ceremony. She told the magazine that she enjoys singing musical that appeals to all ages and she doesn’t plan on changing that:

“There is an obvious element in me that wants to entertain people and make their faces light up. So I won’t only be singing songs about being a married woman.”

“The Bachelorette” contestant Chris Lambton, who was dumped by Ali Fedotowsky for her fiancé Roberto Martinez, has found love and is currently dating “The Bachelor Pad” contestant Peyton Wright.

Peyton and Chris met at one of the Bachelor/Bachelorette reunions and hit it off. The two have been keeping a long distance relationship since August of 2010. “We met at a Bachelor function,” Peyton says. “It’s long distance so we’re on the phone and iChatting a lot.”

Of the day they first met, Peyton says, “It’s one of those things where I’ve had a ton of serious relationships and I met this kid and he was genuine, outgoing and hilarious and we just click.”

Chris actually refused to become the next Bachelor after he realized that wasn’t the right way to find true love. “That’s just not me,” Chris said. “Sitting at home and watching the season with my family weirded me out. I wanted to find love on my own and not in that type of situation, so I said, ‘You know what? I’m not going to do it.’”
