“There’s a clear conflict if one spouse is seeking a divorce, but the other wants an annulment,” family law attorney Scott Weston, told People. “A judge will have to decide which to allow, which could take many months.”

It seems that Kardashian was originally leaning to the annulment before her lawyers convinced her to file for divorce. According to California law, if Humphries can prove their marriage was never legitimate, he may get his wish. If not, he will seek a legal separation rather than divorce.
