Kim Kardashian may have separated from her husband Kris Humphries 72 days after their marriage, but over a year later, the reality star is still going through the divorce process.

“Ms. Kardashian is now handcuffed to Kris Humphries,” her attorney Laura Wasser told an L.A. Superior Court judge Wednesday. “These delays are forcing her to be married. She wants to dissolve her marriage so she can move on with her life. I don’t think [Kris] has a case, it’s a fishing expedition.”

“We want a trial because that’s the only way this will end. There was no fraud,” Wasser told PEOPLE outside the courtroom.

Humphries, who is seeking an annulment, and his team have gathered evidence in attempt to prove that the marriage was a fraud. They have deposed her mother, Kris Jenner, her wedding planner and even her current boyfriend, Kanye West. The basketball player has claimed in documents that Kardashian ”had no intent of being married” and that it was all “for the benefit of her TV show.”

A hearing is set for Feb. 15 to determine a start date for the trial.
