Model Gabriel Aubry was hospitalized and arrested after a physical altercation with actor Olivier Martinez at Academy Award winner Halle Berry‘s home on Thanksgiving.

Law enforcement sources said the fight broke out when Aubry, Berry’s ex, arrived with his daughter Nahla, 4, for a custodial handoff to Berry. Martinez, Berry’s current fiance, told Aubry, ”We have to move on,” which prompted Aubry to throw a punch and push the actor.

The two struggled until Martinez was able to pin Aubry to the ground. He is said to have suffered “a broken rib, contusions on his face and a possible head injury.” Martinez reportedly broke his hand and suffered neck injuries.

The Associated Press reported that Aubry was arrested and booked for investigation of battery, a misdemeanor charge. He was released on $20,000 bail, with a court date set for Dec. 13.

Berry and Aubry have been involved in a dramatic custody battle since they split in 2010. Last month, a judge ruled that Berry wouldn’t be allowed to move to France full-time with Nahla.

And now a judge ordered the 45 year-old to pay child support. Halle is forced to fork nearly a quarter of a million dollars in monthly checks of $20,000 to Gabriel. However, the legal war between Halle and Gabriel is far from over.

Halle is planning on taking her daughter and moving to Paris, France to be closer to her fiancé. The actress will have to go to court to fight for her right to move since Gabriel vigorously opposes.

French heartthrob Olivier Martinez has finally confirmed that he and actress Halle Berry are officially engaged during the opening of his new restaurant Villa Azur in South Beach, Miami over the weekend.

When asked if the engagement rumors were true, Olivier said “Yes, of course it’s true.” However, there is one rumor that is not true – the sketchy jeweler taking credit for designing Halle’s engagement ring is a fraud.

According to the 46 year-old, the special ring was designed by an artist, a French jeweler named Robert Mazlo, who designed for “kings and queens for many centuries”. That’s appropriate. Halle should be treated like a queen.

Halle was previously in a long relationship with ex-boyfriend Gabriel Aubry with whom she has a 3 year-old daughter named Nahla Ariela. The actress vowed to never marry again after two failed marriages with David Justice and Eric Benét, but she is seems to be eager to give Olivier a chance.
